• Contains hate speech, harassment, threats, or other harmful content.

• Contains pornography or explicit adult content.

• Promotes illegal activities or encourages others to engage in illegal activities.

3. Account Termination

We reserve the right to terminate or suspend your account and access to File Storage at any time, without prior notice or liability, for any reason, including but not limited to your violation of these Terms or engaging in illegal activities.

4. Data Governance and Auditing

5. Privacy of User Files

We will not scan or have access to any files uploaded to File Storage without explicit consent from the user. However, we reserve the right to scan files uploaded to File Storage for the following purposes:

• Security Scanning: Files may be scanned for security purposes to detect and prevent malware, viruses, or other security threats that could harm the integrity of our systems or compromise user data.

• Explicit Content and Illegal Content Reviews: We also reserve the right to review files uploaded to File Storage for explicit or illegal content in order to ensure compliance with our Terms of Use and applicable laws and regulations. This includes but is not limited to content that violates our policies regarding hate speech, harassment, threats, pornography, or illegal activities.

These scanning activities will be conducted in accordance with our privacy policy and applicable laws, and any data collected or accessed during these scans will be handled in accordance with our data governance measures.

6. Limitation of Liability

To the fullest extent permitted by applicable law, KLUSTR.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of File Storage.

• Any conduct or content of any third party on File Storage.

• Any unauthorized access to or use of our servers and/or any personal information stored therein.

• Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via File Storage.

7. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
